The circuit court determined the state was likely to succeed in its appeal of the district court’s decision.
The Ninth Circuit U.S. Court of Appeals stayed an injunction from a district judge, which allows Idaho to enforce its Defense of Life Act, banning abortion, as a lawsuit against the state law proceeds. The appellate court determined that the state is likely to succeed on appeal.
A federal judge ruled in August that Idaho had to allow abortions in cases where a doctor deemed it necessary in order to protect the health of the mother. However, the circuit court wrote, “The Supreme Court in Dobbs v. Jackson Women’s Health Organization plowed the same ground and held that ‘the Constitution does not confer a right to abortion.’”
Idaho’s Attorney General Raul Labrador stated, “Idaho’s law will remain in full effect during the appeal process. Idaho’s unwavering protection for unborn children and their mothers will continue as intended.”
As the Lord Leads, Pray with Us…
- For the judges of Circuit Courts as they consider cases challenging the constitutionality of state laws.
- For state attorneys general as they seek to uphold and ensure compliance with laws surrounding abortion.
